Terms of Service

These Terms of Service are the contract between you and SKE (“we”, “us”) for using SKE: ske.io, the dashboard at app.ske.io, the SKE API, the ske command-line tool, the SKE adapter that runs your application in your cloud account, and the Laravel bridge. You agree to them by ticking “I agree to the Terms of Service” when you create an account, whether you register or accept an invitation. How we handle personal data is explained in our Privacy Policy, which isn’t part of this contract.
1. Who can use SKE
- You must be 18 or older.
- SKE is built for businesses and professionals, including freelancers and developers working for themselves. You can also use it for personal projects. If you do, section 15 gives you extra rights as a consumer.
- If you use SKE for a company or other legal entity, you confirm you are allowed to accept these Terms for it. “You” then means that entity too.
- You can’t use SKE if the law or sanctions forbid you from receiving it.
2. Your account
- You sign in with a link we email you. Your email inbox is the key to your account, so keep it secure.
- You are responsible for what happens in your account and your organizations, including actions taken with API tokens and MCP clients you authorize.
- Tell us through our contact form as soon as you think someone else has accessed your account.
- If we think your account or one of your tokens has been compromised, we may sign you out or revoke the token until it’s secure, and we’ll tell you.
- An organization’s Owners and Admins decide who can join and what each person can do. They can see everyone’s activity in the organization, including the audit log.
3. Your cloud accounts
SKE creates and runs resources in the AWS account or Google Cloud project you connect, using the access you grant. This changes who is responsible for what:
- Cloud charges are yours. Your cloud provider bills you directly for every resource in your account, including the ones SKE creates on your instructions, and for the calls SKE makes to run them, such as reading metrics every few minutes and keeping functions warm. SKE’s own fees, if any, are separate. Cost estimates in SKE are estimates only.
- You stay in control. You choose the regions, sizes and scaling limits. Set budgets and billing alerts in your cloud account. SKE acts only on your instructions and within the permissions you grant.
- Credentials. You connect SKE through an IAM role or a service account with the permissions our docs list, and you can revoke that access at any time. Those permissions are broad, because SKE creates and manages resources for you. You are responsible for actions taken with credentials you issue, as your cloud provider’s own terms say. We keep the credentials encrypted and use them only to provide SKE.
- Shared security. We secure SKE and the credentials it stores. You secure your code, your configuration and your cloud account, and you keep your own backups.
- Your cloud provider’s rules apply. You must follow your cloud provider’s terms and acceptable use policy for everything you run.
- Secrets. Keep passwords, keys and other credentials out of console commands, tinker and the
env:block ofske.yml, and store them as SKE secrets instead. What you type in the console is kept in your organization’s audit log for 12 months. - When you leave, your resources stay in your cloud account and keep costing money until you delete them. We never delete your cloud resources unless you ask us to, for example by deleting an environment in SKE. We delete the credentials we hold when your organization’s data is deleted (section 9). To end our access at once, delete the IAM role or the service account key you created for SKE.
4. Acceptable use
You must not use SKE to:
- break the law or anyone’s rights, or host content that does;
- send spam, or phish or deceive people;
- attack, probe or overload any system, including SKE, without permission;
- mine cryptocurrency, or run anything that harms the networks SKE uses;
- get around limits, access controls or billing, or access other customers’ data;
- resell SKE as a service without our written permission.
We may remove content or suspend access that breaks this section, as described in section 9.
5. Your content
- You own your code, configuration, data and applications (“your content”). We claim no ownership of it.
- You give us the right to host, copy, process and transmit your content only as needed to provide SKE to you and to keep it secure.
- We may use aggregated data that can’t identify you, your organization or your users, such as counts of deployments, to run and improve SKE.
- You are responsible for your content and for having the rights to use it.
6. Personal data you give us to process
When SKE handles personal data for you, for example the emails your application sends that SKE’s mail catcher stores, you are the controller, or a processor acting for your own customer, and we are your processor. Our Data Processing Agreement applies to that data and forms part of these Terms. The current list of our sub-processors is at ske.io/subprocessors.
7. Other services
SKE works with services we don’t run, such as AWS, Google Cloud, GitHub, Slack and your email provider. Their own terms apply to your use of them, and we aren’t responsible for them.
8. Fees
SKE has no paid plans today. If we introduce them, the price, what’s included and how renewal works will be shown before you subscribe, and nothing will be charged without your agreement. You will be able to cancel a paid plan online at any time.
9. Leaving, suspension and deletion
- You can leave at any time. To close your account, ask us through our contact form, giving the email address on the account. An Owner can delete an organization in its settings. If you’re the only Owner of an organization that has other members, make one of them an Owner first, or delete the organization. There are no exit fees.
- We may suspend or close access if you seriously or repeatedly break these Terms, if your use puts SKE, other customers or anyone else at risk, or if the law requires it. We’ll tell you why and, where we can, give you notice and a chance to fix the problem first. We can also end SKE, or your use of it, for any other reason with at least 30 days’ notice.
- After an organization is deleted, including one deleted with its only member’s account, we keep it for 30 days and will restore it if an Owner asks through our contact form. If it was deleted with its only member’s account, that person can ask once they have signed up again. After that, we delete it for good, as our Privacy Policy describes. Your resources stay in your cloud account (section 3).
10. SKE is provided as is
We work to keep SKE reliable, but we don’t promise it will be available without interruption or free of errors. There is no service level agreement.
Beta features. Features marked Beta or Early access, such as Google Cloud support today, may change or be removed at any time and come with no promises.
Changes to SKE. We add, change and remove features over time. If we remove something you rely on, we’ll tell you at least 30 days before, unless security or the law needs a faster change.
TO THE EXTENT THE LAW ALLOWS, SKE IS PROVIDED “AS IS” AND “AS AVAILABLE”, AND WE DISCLAIM ALL WARRANTIES NOT STATED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
This doesn’t limit any rights you have as a consumer that can’t be excluded (section 15).
11. Our liability
- Indirect loss. Neither of us is liable for indirect or consequential loss, or for lost profits, revenue, data or goodwill. This doesn’t limit section 12.
- Cloud charges caused by our bugs. If a defect in SKE causes charges in your cloud account that you wouldn’t otherwise have had, those charges count as direct damages, within the cap below. Tell us promptly when you notice them.
- The cap. Our total liability for all claims under these Terms is limited to the greater of the fees you paid us in the 12 months before the event that caused the claim, or US$100.
- What isn’t limited. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn’t allow to be limited.
12. Your responsibility for claims
If you use SKE for a business, you will cover SKE for claims that other people bring against it because of your content, your applications or your breach of these Terms, including the losses and reasonable costs they cause. We’ll tell you promptly about such a claim and let you control its defense.
13. Changes to these Terms
- Material changes, such as to fees, liability, disputes, how we use data, or anything that reduces your rights: we email everyone with an SKE account at least 30 days before they take effect, with a summary of what changed. You’ll be asked to accept the new Terms at your next sign-in. If you don’t agree, you can close your account before the change takes effect. If you keep using SKE after that date without signing in, for example only through API tokens, the new Terms apply to you from that date.
- Other changes, such as new features or clarifications: we tell you by email or in SKE, and they take effect on the date we give.
- Every version of these Terms stays published under Versions.
14. Law and disputes
If you have a dispute with us, tell us through our contact form first, and we’ll try to resolve it with you. Nothing in these Terms takes away your right to go to court, including, if you use SKE as a consumer, in the courts where you live (section 15).
15. If you use SKE as a consumer
If you use SKE for purposes outside your trade, business or profession:
- you keep the protections that the law of your home country gives consumers and doesn’t allow a contract to take away, and you can bring a claim in the courts where you live;
- when paid plans exist, you’ll have 14 days from subscribing to withdraw and get a refund, less the value of anything you asked us to provide in that time;
- the limits in sections 10 and 11 apply only as far as consumer law allows, and section 12 doesn’t apply to you.
16. General
- SKE’s software. While these Terms apply, you may use the
skecommand-line tool and the SKE adapter, which SKE builds into your application’s image, to use SKE. The Laravel bridge (ske/laravel-bridge), and any other part we publish under an open-source licence, is covered by that licence. Everything else in SKE belongs to us. - Notices. We send notices to the email address on your account. Send notices to us through our contact form.
- Transfer. You can’t transfer these Terms without our permission. We can transfer them to a company that takes over SKE, and we’ll tell you if we do.
- Events outside our control. Neither of us is liable for delays or failures caused by events outside reasonable control.
- Export and sanctions. You must comply with the export control and sanctions laws that apply to your use of SKE.
- Language and records. These Terms are in English. We keep a record of the version you accepted and when, and every version stays published (section 13).
- After you leave. Sections 9 to 12, 14 and 15 keep applying after your account closes.
- Whole agreement. These Terms, with the Data Processing Agreement where it applies, are the whole agreement between us about SKE.
- If a part is invalid, the rest still applies.
- Not enforcing a term now doesn’t stop either of us from enforcing it later.
